IMPORTANT — READ BEFORE USING WYLD GROW
WYLD GROW IS FOR EDUCATIONAL AND INFORMATIONAL PURPOSES ONLY. Every growing schedule, irrigation calendar, nutrient program, task, notification, AI-generated suggestion, and piece of cultivation content in the Services — for food crops, ornamentals, and cannabis alike — is educational information. It is not a guarantee of any result, and it is not professional agricultural, horticultural, legal, medical, or financial advice.
YOU, AND ONLY YOU, ARE RESPONSIBLE FOR CONFIRMING THAT WHAT YOU GROW IS LEGAL WHERE YOU GROW IT. WYLD Grow does not know where you live, does not verify your local laws, and cannot tell you whether home cultivation of any plant — including cannabis — is lawful in your country, state, province, county, city, building, or lease. Before you follow any guidance in the Services, you must independently confirm that your cultivation is legal, that you meet every applicable age, plant-count, licensing, and location requirement, and that you have any permission you need from a landlord, homeowners' association, or similar authority. If you are not certain your cultivation is legal, do not do it.
WYLD GROW IS AN EDUCATIONAL PLATFORM. Some of the educational information in the Services concerns plants whose cultivation is regulated, restricted, or prohibited in some jurisdictions, including cannabis. Providing that information is not an offer, invitation, or encouragement to cultivate any plant, and WYLD Grow does not sell, supply, distribute, or ship cannabis, cannabis seeds, clones, or cannabis products of any kind.
YOU MUST BE AT LEAST 18 YEARS OLD — and at least the minimum legal age for cultivation in your jurisdiction, if higher — to create an account or use any part of the Services.
THESE TERMS CONTAIN A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER (Section 17), a release of liability, an assumption of risk, and a limitation of damages. You may opt out of arbitration within 30 days of creating your account (Section 17.6).
1. Acceptance of These Terms
1.1 These Terms of Service ("Terms") are a legally binding agreement between you ("you," "your," "User") and Wyld App Inc. ("WYLD Grow," "Company," "we," "us," "our") governing your access to and use of the WYLD Grow mobile application (the "App"), the website at www.wyldgrow.com (the "Website"), our online store through which we resell third-party plant nutrients, growing supplies, and related products (the "Store"), and all related features, content, and services (collectively, the "Services").
1.2 How you accept. You accept these Terms by doing any of the following: completing the mandatory certification step during account creation (which requires you to confirm you are 18 or older, accept these Terms, and accept our Privacy Policy); checking any acceptance box presented in the Services; placing an order in the Store; or accessing or using any part of the Services. If you do not agree to these Terms, do not use the Services.
1.3 Incorporated documents. Our Privacy Policy, any product-specific terms presented at checkout, and any additional guidelines or rules we post for particular features ("Supplemental Terms") are incorporated into and form part of these Terms. If a Supplemental Term conflicts with these Terms, the Supplemental Term governs for that feature only.
1.4 Organizations. If you use the Services on behalf of a company or other entity, you represent that you are authorized to bind that entity to these Terms, and "you" includes that entity.
1.5 Right to counsel. You acknowledge that you have had the opportunity to review these Terms with an attorney of your choosing before accepting them.
2. Eligibility — 18 Years or Older
2.1 Minimum age. You must be at least eighteen (18) years of age to create an account or use any part of the Services. If the jurisdiction in which you are located sets a higher minimum age for home cultivation of any plant you grow, you must also meet that higher age. The Services are not directed to, and may not be used by, anyone under 18 under any circumstances. There is no parental-consent pathway.
2.2 Age certification. When you create an account you must certify that you are 18 or older. By doing so you represent and warrant that this certification is true. You further represent and warrant that all registration information you provide is truthful, accurate, and complete, and that you will keep it that way.
2.3 Verification. We may, at any time and in our sole discretion, require you to provide proof of age, identity, or location. Failure to comply with a reasonable verification request within fourteen (14) days may result in suspension or termination of your account. This age requirement is consistent with App Store and Google Play ratings for educational applications of this kind; it is not, and is not intended to satisfy, any age requirement that applies to the cultivation of a particular plant where you live, which remains your responsibility under Section 5.
2.4 Consequences of misrepresentation. If we determine that you are under 18 or that you provided false age, identity, or location information: your account will be terminated; you will forfeit any fees paid; you may not re-register under a different name or email; and we may report the matter to law enforcement or app-platform authorities where appropriate. You remain responsible for any harm caused by your misrepresentation, including indemnifying us under Section 16 for any resulting cost or legal exposure. Knowingly providing false age information to obtain access to age-restricted content may constitute fraud under applicable law.
2.5 One account per person. You may maintain only one account. You may not create an account using false information, impersonate any person, or create accounts on behalf of anyone other than yourself (except as permitted for organizations under Section 1.4 or team members under Section 6.3).
2.6 Geographic and legal restrictions. We may deny or cancel access to the Services, or to any part of them, based on your geographic location or our determination that your use is not permitted under applicable law. You represent and warrant that (a) you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and (b) you are not on any U.S. Government list of prohibited or restricted parties.
3. The Services and Subscription Plans
3.1 What WYLD Grow is. WYLD Grow is a digital cultivation-guidance platform providing growing schedules, irrigation calendars, task management, cultivation records, and plant cultivation information, and operating a Store through which we resell third-party nutrients and growing supplies (Section 8).
3.2 Plans. We offer the Services under one or more subscription plans. The features, limits (including any limit on the number of gardens), price, and billing period of each plan are those displayed to you at the time of purchase and in your account settings. Certain plans include educational information about plants whose cultivation is regulated or prohibited in some jurisdictions, including cannabis. That information is educational only (Section 4), is available only to users who have completed the certification in Section 2.2, and is subject to Section 5 in full. We may change the features, limits, and pricing of any plan as described in Section 7.
3.3 Beta and experimental features. We may offer features that are in development ("Beta Features"). Beta Features may change, may work differently from the rest of the Services, may be unreliable, and may be withdrawn at any time without notice.
3.4 Changes to the Services. We may add, remove, modify, suspend, or discontinue any part of the Services at any time. We will use reasonable efforts to notify you of material changes. We are not liable to you or any third party for any such change, and no refund is owed for it except as stated in Section 7.9.
3.5 No obligation of support. We have no obligation to provide maintenance or support for the Services beyond what we choose to offer.
4. Educational and Informational Purpose Only — No Advice — No Guaranteed Results
4.1 Everything is educational. All cultivation information provided through the Services — including schedules, calendars, task lists, reminders, nutrient programs, feeding recommendations, environmental targets, product descriptions, articles, and any output of AI Features (Section 9) — is provided solely for educational and informational purposes. It reflects general cultivation principles and the professional experience of our team. It is not tailored to your specific plants, environment, equipment, or circumstances.
4.2 No professional advice. Nothing in the Services constitutes professional agricultural, horticultural, agronomic, legal, regulatory, medical, health, safety, or financial advice. Do not rely on the Services as a substitute for advice from a qualified professional. Never disregard professional advice, or delay seeking it, because of something you read or received in the Services.
4.3 No guaranteed results. WYLD Grow does not guarantee any yield, plant health, harvest quality, timing, or other outcome. Growing results depend on genetics, environment, climate, water quality, equipment, pests, disease, grower skill, and many other factors entirely outside our control. Following a WYLD Grow schedule does not ensure success, and deviating from one does not ensure failure. Crop loss is your risk.
4.4 Educational information about regulated plants. Where the Services include information about a plant whose cultivation is regulated, restricted, or prohibited in any jurisdiction — including cannabis — that information is provided solely to help informed, legal adult growers understand cultivation principles. It is not a representation that cultivation of that plant is lawful anywhere, not an endorsement, promotion, or facilitation of any unlawful activity, and not medical guidance (cannabis has documented health effects, and nothing in the Services is medical advice). An AI Feature cannot and will not tell you whether cultivating any plant is lawful for you, and nothing it says changes your obligations under Section 5.
4.5 Why we say "educational." This designation is an accurate description of what WYLD Grow provides — expert cultivation knowledge, comparable to a professional growing guide, delivered in an interactive digital format. What you do with that knowledge, and whether it is lawful where you are, is entirely your responsibility.
5. Your Responsibility for Legal Compliance
5.1 You confirm legality before you grow. Before you cultivate any plant using the Services, you must independently confirm that doing so is lawful in the specific place where you will grow it. This includes, without limitation, confirming compliance with:

  • all national, federal, state, provincial, county, municipal, and local laws and ordinances;

  • any minimum age for cultivation, which may be higher than 18;

  • plant-count limits, licensing or registration requirements, and location restrictions (for example, requirements that plants be indoors, locked, or out of public view);

  • lease agreements, homeowners' association rules, building codes, and utility, water, electrical, and fire-safety requirements; and

  • any prohibition on transporting plants or plant material across state, provincial, or international borders.

5.2 We do not verify your laws. WYLD Grow does not verify the laws of your jurisdiction, does not know where you are located, and does not represent that any cultivation activity is lawful anywhere. The availability of any content in the Services in your location is not a representation that the activity it describes is legal there. We rely entirely on your own representations regarding legal compliance.
5.3 Your representation. By using the Services you represent and warrant that your cultivation activities are, and will remain, lawful in your jurisdiction, and that you will immediately stop using any part of the Services that relates to an activity that is or becomes unlawful where you are.
5.4 Regulated and controlled plants. Some plants whose cultivation the Services describe — including cannabis — are controlled substances or otherwise regulated in many places. Many jurisdictions prohibit their cultivation entirely; many that permit it impose age limits above 18, plant-count limits, licensing or registration, security, and location rules. If you grow any such plant, you additionally represent and warrant that you are located in a jurisdiction where your cultivation is lawful; that you meet every applicable age requirement; that you will immediately stop using any related information if you relocate to, or are present in, a place where that cultivation is unlawful; and that you understand legality in one place does not mean legality in another.
5.5 Federal law acknowledgment (United States). If you are located in the United States, you acknowledge that cannabis is a Schedule I controlled substance under the Controlled Substances Act, 21 U.S.C. § 812; that cultivation, possession, and distribution of cannabis remain illegal under federal law regardless of state or local law; that medical use is not a defense under federal law; that transporting cannabis across state or international borders is a federal offense; that federal authorities may enforce federal law regardless of state legalization; that WYLD Grow does not advise you to violate federal law and does not endorse any federally unlawful activity; and that you use the Services with full awareness of this framework and accept all associated risk personally.
5.6 Assumption of risk. Cultivation — and in particular the cultivation of any regulated or controlled plant — carries legal, financial, physical, property, and personal risks that vary by jurisdiction and circumstance. By using the Services you voluntarily and knowingly assume all such risks, including: legal risk (arrest, prosecution, fines, asset forfeiture, conviction, loss of housing or employment); financial risk (loss of investment in equipment, nutrients, media, and facilities); property risk (damage from water systems, electrical setups, humidity, or fire); personal risk (injury, health effects, exposure to plant compounds); and cultivation risk (crop failure, pests, disease, or poor outcomes regardless of guidance followed). YOUR USE OF THE SERVICES IS ENTIRELY VOLUNTARY. YOU HAVE BEEN INFORMED OF THESE RISKS AND ACCEPT THEM COMPLETELY. WYLD GROW BEARS NO RESPONSIBILITY FOR ANY CONSEQUENCE OF YOUR CULTIVATION ACTIVITIES.
5.7 No defense or indemnity from us. WYLD Grow has no obligation to defend, release, or hold you harmless from any civil, criminal, or administrative investigation, proceeding, or penalty that results from your cultivation activities.
6. Accounts
6.1 Account creation. To use the Services you must create an account with a valid email address and password (or an approved third-party sign-in) and complete the certification in Section 2.2. You are responsible for keeping your account information accurate and current.
6.2 Account security. You are solely responsible for maintaining the confidentiality of your credentials and for all activity under your account, whether or not authorized by you. You must not share your credentials. Notify us immediately at hello@wyldgrow.com if you suspect unauthorized access. We are not liable for any loss arising from your failure to protect your account.
6.3 Team collaboration. Where a plan permits it, the account holder ("Garden Owner") may invite a limited number of team members to share garden data. Each team member must be at least 18, must create their own account, and must accept these Terms and the Privacy Policy. The Garden Owner is responsible for ensuring that invited team members comply with these Terms and accepts liability for violations committed by team members within shared gardens.
6.4 Third-party sign-in. If you sign in using Apple, Google, or another third-party service, we may receive information from that service in accordance with its terms and your settings, and that service's terms and privacy policy apply to its handling of your information.
6.5 Account deletion. You may delete your account at any time through the App settings or by contacting hello@wyldgrow.com from the email address on the account. Deletion is permanent. Deleting your account does not cancel a subscription purchased through Apple or Google; you must cancel that separately with the platform (Section 7.8).
7. Subscriptions, Billing, and Payment
7.1 Recurring billing. Subscriptions are billed in advance on a recurring basis (monthly or annually, as selected at purchase) beginning on the date of purchase. Your subscription automatically renews at the end of each billing period, at the then-current non-promotional price for your plan, until you cancel. For clarity, "monthly" means every thirty (30) days or on the same calendar day each month, as determined by the payment platform.
7.2 Payment pathways. Subscriptions may be purchased through one of the following, and your payment data is handled differently depending on which you use:

  • Website (Stripe). Purchases through www.wyldgrow.com are processed by Stripe, Inc. Your card details are entered directly on Stripe's platform; WYLD Grow does not receive, store, or process your card number. By subscribing through the Website you authorize us and Stripe to charge your payment method the applicable fee on a recurring basis until cancellation.

  • Apple App Store. In-app purchases on iOS are processed by Apple. Apple's terms, billing practices, and refund policies govern these transactions. WYLD Grow receives only transaction confirmation and subscription status.

  • Google Play. In-app purchases on Android are processed by Google. Google's terms govern these transactions. WYLD Grow receives only transaction confirmation and subscription status.

Subscriptions purchased through Apple or Google are "Platform Subscriptions." Cancellations, refunds, billing disputes, and payment-method changes for Platform Subscriptions must be handled through the applicable platform, not through WYLD Grow.
7.3 Payment method. You must provide a current, valid, accepted payment method and keep it current. You are responsible for any fees imposed by your bank, card issuer, or mobile carrier, including foreign transaction fees. If a charge fails, we may suspend or cancel your subscription and restrict access until payment is received.
7.4 Free trials. We may offer a free or discounted trial period for certain plans. A trial automatically converts to a paid subscription at the full price shown at sign-up when the trial ends, unless you cancel before the trial expires. You are entitled to one trial per person, per lifetime, across all accounts and platforms. Attempting to obtain more than one trial — including by creating additional accounts — is a material breach of these Terms and grounds for immediate termination without refund.
7.5 Price changes. We may change subscription prices. We will give you at least thirty (30) days' notice by email or in-app notification before a price change takes effect on your renewal. If you do not accept the new price, cancel before the renewal date. Continuing to use the Services after the new price takes effect is acceptance of it.
7.6 Taxes. Prices are stated in U.S. dollars and, unless stated otherwise, exclude sales, use, VAT, GST, and other taxes, which will be added where required by law. You are responsible for all such taxes.
7.7 Promotional and third-party offers. If your subscription is provided through a promotional bundle or by a third party, that third party's terms govern payment, renewal, and cancellation, and you must contact that third party for those matters.
7.8 Cancellation. You may cancel at any time:

  • Website subscriptions: in account settings at www.wyldgrow.com or by emailing hello@wyldgrow.com.

  • Apple App Store subscriptions: in your Apple ID subscription settings.

  • Google Play subscriptions: in Google Play subscription management.

Cancellation takes effect at the end of the current billing period. You keep access until then. We do not prorate or refund partial periods. Deleting the App does not cancel a subscription.
7.9 Refunds. All subscription fees are non-refundable except: (a) where a verified technical failure on our part completely prevented access to the Services for a substantial part of a billing period; (b) for duplicate charges caused by our billing error; or (c) where a refund is required by applicable consumer-protection law. Refund requests for Website subscriptions must be sent to hello@wyldgrow.com within fourteen (14) days of the charge with your account email and a description of the issue. Refund requests for Platform Subscriptions must be made to Apple or Google under their policies; WYLD Grow cannot issue refunds for Platform Subscriptions.
7.10 Right of withdrawal — EU, EEA, and UK consumers. If you are a consumer in the European Union, European Economic Area, or United Kingdom, you have the right to withdraw from a Website subscription within fourteen (14) days of purchase, for any reason, without penalty. When you subscribe you may be asked to request immediate access to the Services during the withdrawal period; if you do, you acknowledge that you will be charged a proportionate amount for the Services used up to the date you withdraw, and that once the Services have been fully performed within the withdrawal period you lose the right to withdraw. To exercise this right, email hello@wyldgrow.com within the 14-day period with your name, account email, purchase date, and a clear statement that you wish to withdraw; you may, but need not, use the model withdrawal form at www.wyldgrow.com/withdrawal. We will refund all amounts owed within fourteen (14) days of receiving your notice, using the payment method you used. For Platform Subscriptions, exercise this right through Apple or Google. Nothing in these Terms limits the statutory rights of EU, EEA, or UK consumers, including rights under the Consumer Rights Directive, the Consumer Rights Act 2015, and any right to bring proceedings in the courts of your country of residence (see Section 17.11).
8. Online Store — Third-Party Nutrients and Growing Supplies
8.1 Who you are buying from. In plain terms: Hydroponic Research Inc. manufactures and ships the products; Wyld App Inc. only processes the sale. The Store offers plant nutrients, growing media, supplies, and related physical products ("Products") that are formulated, manufactured, branded, labeled, packaged, warehoused, and shipped by Hydroponic Research Inc., a California company ("Hydroponic Research" or the "Manufacturer"), or by such other independent manufacturer as may be identified on the Product page. Wyld App Inc. acts solely as a third-party retailer: we display the Products, take your order, and process your payment. Wyld App Inc. does not manufacture, warehouse, handle, or ship any Product; holds no ownership interest in, and is not affiliated with, Hydroponic Research or any other Manufacturer; and no Manufacturer is an agent, partner, or sponsor of Wyld App Inc. Manufacturer names, logos, and trademarks appearing in the Services belong to their respective owners and are used only to identify the Products offered. We make no representation, warranty, or claim about any Product beyond passing through the information the Manufacturer provides to us. The Store does not sell cannabis, cannabis seeds, clones, or any cannabis product.
8.2 Product recommendations are informational only. Where the Services recommend, reference, or schedule the use of a Product — whether in a nutrient program, a feeding calendar, a task, an article, or AI Output — that reference is educational information under Section 4 and not an endorsement, guarantee, or warranty of the Product or its Manufacturer. We are not responsible for the formulation, quality, safety, labeling, regulatory compliance, or performance of any Product, or for any claim a Manufacturer makes about it. You are free to use any product of your choosing; the Services are not conditioned on purchasing from the Store.
8.3 Fulfillment, shipping, and handling are performed by Hydroponic Research. When you place an order, Wyld App Inc. processes your payment and transmits the order to the Manufacturer. The Manufacturer — not Wyld App Inc. — is solely responsible for picking, packing, handling, shipping, delivering, and distributing the Products, and for compliance with all laws governing the storage, transport, and shipment of the Products (including hazardous-material, liquid-shipping, and agricultural-input regulations). Shipping regions, carriers, methods, costs, and estimated delivery times are determined by the Manufacturer and shown at checkout; delivery estimates are not guaranteed. Wyld App Inc. is not liable for delays, non-delivery, loss, damage in transit, mis-shipment, or shipping-restriction cancellations, all of which are the responsibility of the Manufacturer or carrier. By placing an order you authorize us to share your name, shipping address, contact details, and order details with the Manufacturer and its carriers for the purpose of fulfilling the order, as described in the Privacy Policy, and you agree that the Manufacturer's own terms and conditions (available at hydroponic-research.com) govern the Manufacturer's performance of the order.
8.4 Orders and acceptance. Your order is an offer to purchase. An order confirmation is an acknowledgment, not an acceptance; an order is accepted when the Manufacturer ships it. We or the Manufacturer may refuse, limit, or cancel any order for any reason, including suspected fraud, pricing or inventory errors, shipping-address irregularities, orders that appear to be for resale, or orders to locations the Manufacturer does not serve. If a paid order is cancelled you will be refunded the amount paid.
8.5 Legitimate orders only. You may use the Store only to place genuine orders for yourself or for a person on whose behalf you are authorized to act. Placing an order under a false name, with a payment method you are not authorized to use, or with false shipping information is a violation of these Terms and may be a violation of law. If you order on behalf of someone else you are responsible for the accuracy of the information you provide, for all charges, and for informing that person of these Terms.
8.6 Pricing and availability. Prices and availability are set in consultation with Manufacturers and may change without notice. Products may occasionally be mispriced or listed as available when the Manufacturer is out of stock. If a Product's correct price is higher than the price at which you ordered, we will contact you and either cancel the order and refund you, or proceed at the correct price with your consent.
8.7 Title and risk of loss. Title to Products and risk of loss pass to you when the Manufacturer delivers the Products to the carrier.
8.8 Returns, refunds, damaged goods, and defects — Hydroponic Research's policy applies. Because the Manufacturer ships the Products, returns and replacements are handled under the Manufacturer's Returns Policy, currently published at https://hydroponic-research.com/returns/ and incorporated into these Terms by reference. As of the Last Updated date, that policy provides that:

  • refunds and returns are subject to a fifteen percent (15%) restocking fee to cover processing costs;

  • Products must be unopened, in brand-new condition, with no visible damage to the packaging, and must be returned at your expense;

  • Products that arrive damaged in shipping will be replaced; and

  • to start a refund or replacement, you must complete the Manufacturer's return form and include your sales receipt, photographs, and the Product batch number.

Refunds are issued to the payment method used for the order, no later than fourteen (14) days after the Manufacturer receives the returned Products. Opened Products, Products not in their original condition, and Products unsuitable for return for health, hygiene, or safety reasons once unsealed are not returnable except where defective on arrival. If the Manufacturer's published policy changes, the version in effect at the time of your order applies. You may contact hello@wyldgrow.com for help locating the Manufacturer's return form; Wyld App Inc. will issue any refund the Manufacturer approves but does not itself accept returned goods. EU, EEA, and UK consumers additionally have the statutory right to withdraw from a Product purchase within fourteen (14) days of receiving the goods, without giving a reason, by notifying hello@wyldgrow.com; you must return the goods within fourteen (14) days of giving notice, you bear the direct cost of return unless the Product is defective, no restocking fee applies where prohibited by law, and the price and standard delivery cost will be refunded within fourteen (14) days of receipt of the goods or proof of their return. This statutory right does not apply to sealed goods unsealed after delivery where they are not suitable for return for hygiene or safety reasons.
8.9 Product warranties are the Manufacturer's. Any warranty on a Product is provided solely by its Manufacturer under the Manufacturer's terms. Wyld App Inc. provides no warranty of any kind on any Product and, to the fullest extent permitted by law, disclaims all implied warranties of merchantability and fitness for a particular purpose with respect to Products. Warranty claims must be directed to the Manufacturer; we will provide the Manufacturer's contact details on request. Nothing in this Section limits the non-waivable statutory rights of consumers.
8.10 Product use and safety. Products are agricultural inputs. You agree to read and follow all Manufacturer label directions, warnings, safety data sheets, and storage instructions; to keep Products out of reach of children and animals; not to consume Products or apply them in a manner inconsistent with the label; and to comply with all laws applicable to the purchase, storage, use, and disposal of fertilizers and growing supplies in your jurisdiction. Products are not for human or animal consumption. We make no warranty that any Product will produce a specific cultivation result.
8.11 Product subscriptions (auto-ship). If you enroll a Product in a recurring delivery program, you authorize us to charge your payment method and to transmit a recurring order to the Manufacturer at the interval you select until you cancel. Cancellations and changes to auto-ship orders are handled directly by Hydroponic Research, using the contact details provided at checkout, in your order confirmation, and at https://hydroponic-research.com/contact; a cancellation takes effect for shipments not yet dispatched at the time the Manufacturer processes it. Price changes for auto-ship Products will be notified to you at least thirty (30) days before they take effect.
8.12 Promotional codes. Promotional codes are single-use unless stated otherwise, cannot be combined, have no cash value, and may be withdrawn at any time. We may cancel orders or revoke discounts obtained through misuse of a code.
9. AI Features
9.1 What they are. The Services may include features powered by artificial intelligence or machine learning — for example, plant-photo analysis, diagnosis suggestions, personalized schedule adjustments, a cultivation assistant, or automatically generated content (collectively, "AI Features"). AI Features may not be available at all times or on all plans, and the list of AI Features may change as we add, modify, or remove them. This Section applies whenever any AI Feature is offered. Some AI Features may be Beta Features.
9.2 AI output is educational information — nothing more. Everything an AI Feature produces ("Output") is subject to Section 4 in full. Output is generated automatically, may be inaccurate, incomplete, out of date, or wrong, and may sometimes be presented confidently while still being wrong. Output is not professional advice of any kind, is not a diagnosis, and is not a guarantee of any result. You must use your own judgment, and where appropriate the judgment of a qualified professional, before acting on any Output. We are not responsible for any action you take, or fail to take, in reliance on Output.
9.3 AI Features cannot tell you whether your cultivation is legal. AI Features have no knowledge of your location or the laws that apply to you, and are not designed or permitted to determine legality. Any statement by an AI Feature about the law is not legal advice and must not be relied upon. Your obligation under Section 5 to independently confirm that your cultivation is lawful applies without exception to anything an AI Feature says or suggests. We may configure AI Features to decline questions about legality; a refusal or an answer is not a representation about your legal position either way.
9.4 Your inputs. You are responsible for everything you submit to an AI Feature ("Input"), including photographs, text, and garden data. You must not submit Input that: violates any law or these Terms; contains personal information about any other person (including images of other people) without their consent; contains sensitive personal data (such as health, biometric, or precise geolocation data) unless a feature specifically requests it; or that you do not have the right to share. You agree not to use AI Features to generate content that is unlawful, harmful, misleading, or infringing, or to attempt to extract our proprietary cultivation data, prompts, or models.
9.5 Rights in Input and Output. As between you and WYLD Grow, you own your Input and, to the extent permitted by law, your Output. You grant WYLD Grow a worldwide, non-exclusive, royalty-free, sublicensable license to use, store, reproduce, and process your Input and Output to provide, maintain, secure, and improve the Services and AI Features. We may use Input and Output to improve the Services and AI Features; where an AI Feature is offered, you may opt out of the use of your Input and Output for model training in your account settings. Output may not be unique to you; similar Output may be provided to other users.
9.6 Third-party AI providers. AI Features may be provided in part by third-party model providers. Your Input may be transmitted to those providers to generate Output, subject to our Privacy Policy. We are not responsible for the availability or accuracy of third-party models.
9.7 Labeling and limits. We may label content as AI-generated and may impose limits on the use of AI Features (such as usage caps or feature availability by plan). We may suspend or modify your access to AI Features at any time, including for misuse.
10. Intellectual Property
10.1 Our content. All software, algorithms, cultivation calendars, irrigation schedules, crop-steering protocols, nutrient programs, plant guides, text, images, graphics, logos, trademarks, look and feel, and other materials in the Services (collectively, "WYLD Grow Content") are the exclusive property of Wyld App Inc. or its licensors and are protected by copyright, trademark, trade-secret, and other laws. WYLD Grow Content represents a substantial proprietary investment incorporating over 25 years of professional commercial cultivation expertise — including our cultivation calendars, irrigation schedules, crop-steering protocols, and nutrient programs — and constitutes our trade secrets. You may not share, reproduce, or transmit any schedule, calendar, protocol, or nutrient program, in whole or in part, to any person, publication, or platform. All rights not expressly granted are reserved. The WYLD Grow name and logo are our trademarks; you may not use them without our prior written consent.
10.2 Your license. Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services and WYLD Grow Content, on devices you own or control, solely for your own lawful cultivation purposes during an active subscription. The Services are licensed, not sold.
10.3 Restrictions. You will not, and will not permit anyone else to: (a) copy, reproduce, publish, distribute, transmit, or publicly display any WYLD Grow Content; (b) screenshot, screen-record, or otherwise capture any part of the Services for redistribution or commercial use; (c) scrape, crawl, harvest, or extract data from the Services by any automated or manual means; (d) reverse engineer, decompile, disassemble, or attempt to derive the source code, data structures, or underlying cultivation data of the Services, except to the extent applicable law expressly prohibits this restriction; (e) create derivative works, competing products, or datasets — including datasets for training AI or machine-learning models — from WYLD Grow Content; (f) sell, rent, lease, sublicense, or otherwise commercialize the Services or WYLD Grow Content, or access the Services to build a similar or competitive product; (g) remove or alter any proprietary notice; (h) circumvent any technical measure that controls access to or protects the Services — screenshot and screen-recording functionality may be disabled in parts of the App as an enforcement measure, and attempting to circumvent it is a material breach; or (i) frame or mirror any part of the Services or deep-link to it for commercial purposes without our written consent. Violation of this Section terminates your license immediately and may expose you to civil and criminal liability.
10.4 Your content. Garden data, records, notes, photographs, and other content you submit to the Services ("Your Content") remain yours. You grant WYLD Grow a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, process, adapt, and display Your Content solely to the extent needed to provide, maintain, secure, and improve the Services, and, if you choose to make any of Your Content public or share it with team members, to display it to those people. You represent that you own or have the rights to Your Content and that it does not violate these Terms or any law or third-party right. We are not obligated to back up Your Content and may delete it on termination.
10.5 Feedback. If you provide suggestions, ideas, or other feedback ("Feedback"), you assign to WYLD Grow all right, title, and interest in the Feedback; where assignment is not permitted by law, you grant us a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use it for any purpose without obligation to you. Feedback is not confidential.
10.6 Copyright complaints (DMCA). We respect the intellectual property of others and will respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act, 17 U.S.C. § 512. If you believe content in the Services infringes your copyright, send our designated agent a written notice containing: (a) your physical or electronic signature; (b) identification of the copyrighted work; (c) identification of the allegedly infringing material and where it appears in the Services; (d) your address, telephone number, and email; (e) a statement that you have a good-faith belief the use is not authorized by the owner, its agent, or the law; and (f) a statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorized to act for the owner. If your content is removed in response to a notice and you believe the removal was a mistake, you may send a counter-notice containing your signature, identification of the removed material and its former location, a statement under penalty of perjury that it was removed by mistake or misidentification, your contact information, and your consent to the jurisdiction of the federal court for your district (or, if outside the United States, the federal courts in Delaware). We may restore the material ten (10) or more business days after receiving a valid counter-notice unless the complaining party files a court action. Under 17 U.S.C. § 512(f), anyone who knowingly misrepresents that material is infringing, or was removed by mistake, may be liable for damages. We will terminate the accounts of repeat infringers. Designated Copyright Agent: Wyld App Inc., c/o Registered Agent, 16192 Coastal Highway, Lewes, DE 19958 — hello@wyldgrow.com.

  • resell, share, or transfer your account, credentials, or subscription, or use the Services for any commercial purpose we have not expressly authorized;

We may review Your Content, investigate suspected violations, remove content, suspend or terminate accounts, and report matters to law enforcement, in each case in our sole discretion and without liability to you.
12. Communications
12.1 Email. By creating an account you agree to receive transactional and account emails from us (for example, receipts, renewal notices, security alerts, and changes to these Terms). We may also send promotional emails; you can opt out of those by following the unsubscribe link in any promotional email.
12.2 Push notifications. The App uses push notifications to deliver cultivation tasks and reminders. You can disable notifications in your device settings, but doing so will prevent the App from delivering scheduled tasks.
12.3 Text messages. By providing a mobile number you consent to receive text messages from us related to your account, including messages sent by automated systems. Message and data rates may apply. Consent to marketing texts is not a condition of purchase. Reply STOP to opt out and START to opt back in. If you change or give up your mobile number, update your account immediately.
12.4 Notices to you. We may give you notice by email to the address on your account, by in-app notification, or by posting on the Website. Notice by email is deemed given twenty-four (24) hours after sending; notice by posting is deemed given when posted. Notices to us must be sent to the addresses in Section 19.10.
13. Third Parties
13.1 Third-party services and links. The Services may link to or integrate with third-party websites, products, or services (including payment processors, sign-in providers, and AI model providers). We do not control and are not responsible for them, and your use of them is at your own risk and subject to their terms.
13.2 Other users. You are solely responsible for your interactions with other users, including team members. We are under no obligation to become involved in any dispute between users.
13.3 Release. To the fullest extent permitted by law, you release and forever discharge WYLD Grow and its officers, directors, employees, agents, licensors, successors, and assigns from every past, present, and future claim, demand, liability, and cause of action of every kind, known or unknown, arising out of or relating to any interaction with, or act or omission of, other users, any Manufacturer, or any third-party product, service, or content. If you are a California resident, you waive California Civil Code § 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." If you are not a California resident, you agree that this release applies to claims you did not know existed when you accepted these Terms.
13.4 Apple App Store. If you obtained the App from the Apple App Store, the following applies. These Terms are between you and WYLD Grow only, not Apple, and Apple is not responsible for the App or its content. Your license to the App is limited to use on Apple-branded devices you own or control as permitted by the App Store Terms of Service. Apple has no obligation to provide maintenance or support for the App. If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the App (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claim by you or a third party relating to the App, including product-liability claims, claims that the App fails to conform to legal or regulatory requirements, and consumer-protection claims. WYLD Grow, not Apple, is responsible for the investigation, defense, settlement, and discharge of any third-party claim that the App infringes intellectual-property rights. You must comply with applicable third-party terms when using the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
13.5 Google Play. If you obtained the App from Google Play, then to the extent the Google Play Terms of Service or other terms Google designates as default end-user license terms conflict with these Terms, the Google terms apply to your use of the App obtained from Google Play. Google has no responsibility or liability for compliance or non-compliance by you or WYLD Grow under these Terms.
14. Disclaimers
THE SERVICES, WYLD GROW CONTENT, AI FEATURES, PRODUCTS, AND ALL INFORMATION PROVIDED THROUGH THEM ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS, AND WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WYLD GROW AND ITS LICENSORS AND SUPPLIERS DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT: (A) THE SERVICES WILL MEET YOUR REQUIREMENTS OR BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (B) ANY CULTIVATION GUIDANCE, SCHEDULE, OR AI OUTPUT IS ACCURATE, COMPLETE, CURRENT, OR SUITABLE FOR YOUR PLANTS OR CONDITIONS; (C) ANY CULTIVATION ACTIVITY IS LAWFUL IN ANY JURISDICTION; (D) THE SERVICES ARE FREE OF VIRUSES OR HARMFUL COMPONENTS; OR (E) ANY PRODUCT WILL PRODUCE ANY PARTICULAR RESULT. PRODUCTS SOLD IN THE STORE ARE MANUFACTURED, WARRANTED, AND SHIPPED BY THIRD-PARTY MANUFACTURERS; WYLD APP INC. MAKES NO WARRANTY OF ANY KIND ABOUT ANY PRODUCT OR MANUFACTURER.
YOU ASSUME ALL RISK ARISING FROM YOUR USE OF THE SERVICES AND ANY RELIANCE ON INFORMATION OBTAINED THROUGH THEM. WYLD GROW IS NOT RESPONSIBLE FOR CROP FAILURE, PLANT LOSS, EQUIPMENT DAMAGE, PROPERTY DAMAGE, PERSONAL INJURY, LEGAL CONSEQUENCES, OR ANY OTHER HARM RESULTING FROM YOUR CULTIVATION ACTIVITIES.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
15. Limitation of Liability
15.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WYLD APP INC. OR ITS OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, AGENTS, LICENSORS, SUPPLIERS, SUCCESSORS, OR ASSIGNS (THE "WYLD GROW PARTIES") BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY; ANY CROP FAILURE, PLANT LOSS, EQUIPMENT LOSS, PROPERTY DAMAGE, OR PERSONAL INJURY; ANY LEGAL PENALTY, FINE, FORFEITURE, OR PROSECUTION; ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA; OR ANY DAMAGES ARISING FROM RELIANCE ON INFORMATION OR OUTPUT OBTAINED THROUGH THE SERVICES — IN EACH CASE HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
15.2 TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF THE WYLD GROW PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE TOTAL SUBSCRIPTION FEES YOU PAID TO WYLD GROW IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). FOR CLAIMS RELATING TO A PRODUCT PURCHASED FROM THE STORE, THE WYLD GROW PARTIES' TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID FOR THAT PRODUCT, AND THE WYLD GROW PARTIES HAVE NO LIABILITY WHATSOEVER FOR THE ACTS, OMISSIONS, PRODUCTS, SHIPPING, OR WARRANTIES OF ANY MANUFACTURER. THE EXISTENCE OF MORE THAN ONE CLAIM WILL NOT ENLARGE THESE LIMITS.
15.3 SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF CERTAIN DAMAGES. IN THOSE JURISDICTIONS OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. THE LIMITATIONS IN THIS SECTION ARE FUNDAMENTAL ELEMENTS OF THE BARGAIN BETWEEN YOU AND WYLD GROW, AND THE SERVICES WOULD NOT BE PROVIDED WITHOUT THEM.
16. Indemnification
You agree to defend, indemnify, and hold harmless the WYLD Grow Parties from and against all claims, demands, investigations, damages, losses, liabilities, judgments, penalties, fines, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of or access to the Services or your purchase, handling, or use of Products; (b) your cultivation activities, any legal action or investigation concerning them, any violation of federal, state, provincial, or local law governing the plants you grow, and any harm to you or any third party resulting from your cultivation; (c) your breach of these Terms or any representation or warranty in them, including any false statement about your age, identity, location, or legal compliance; (d) your violation of any law or third-party right; (e) Your Content or your Input; (f) any activity under your account, including by team members; and (g) any dispute between you and another user or third party. We may assume the exclusive defense and control of any matter subject to indemnification, at your expense, and you agree to cooperate and not to settle any such matter without our written consent. YOUR CULTIVATION ACTIVITIES ARE YOURS. THEIR LEGAL CONSEQUENCES ARE YOURS. WYLD GROW PROVIDES EDUCATIONAL INFORMATION ONLY AND WILL NOT BE DRAWN INTO ANY PROCEEDING ARISING FROM YOUR PERSONAL CULTIVATION CHOICES.
17. Dispute Resolution — Binding Arbitration and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
17.1 Informal resolution first. Before starting arbitration or any other proceeding, you agree to contact us at hello@wyldgrow.com with a written description of the dispute and the relief you seek, and we agree to do the same to you at your account email. Both parties will attempt in good faith to resolve the dispute for at least thirty (30) days after the notice is sent. This step is a condition precedent to arbitration.
17.2 Binding individual arbitration. Except as provided in Sections 17.4 and 17.6, any dispute, claim, or controversy arising out of or relating to these Terms, the Services, Products, or your relationship with WYLD Grow — including claims under the Telephone Consumer Protection Act and any other federal, state, or local law — will be resolved by final and binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect (available at www.adr.org). This agreement to arbitrate is governed by the Federal Arbitration Act. The arbitrator, not any court, has exclusive authority to resolve disputes about the interpretation, applicability, enforceability, or formation of this Section, except that a court decides the enforceability of the class action waiver in Section 17.3. A single neutral arbitrator will conduct the arbitration by telephone, video, or written submissions, or in person in Delaware or the county where you reside. The arbitrator may award the same relief a court could award on an individual basis and must follow these Terms as a court would. Judgment on the award may be entered in any court of competent jurisdiction.
17.3 Class action and jury waiver. YOU AND WYLD GROW EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO BRING OR PARTICIPATE IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION OR ARBITRATION. ALL CLAIMS MUST BE BROUGHT IN A PARTY'S INDIVIDUAL CAPACITY ONLY. If this waiver is found unenforceable as to a particular claim, that claim (and only that claim) will proceed in court under Section 17.9, and the remainder of this Section will continue to apply.
17.4 Exceptions. Either party may (a) bring an individual claim in small claims court if it qualifies, and (b) seek injunctive or other equitable relief in court to protect its intellectual-property rights or to stop unauthorized use of the Services.
17.5 Fees. Payment of AAA filing, administrative, and arbitrator fees is governed by the AAA rules. If you cannot afford the filing fee we will pay it. If the arbitrator finds that a claim was frivolous or brought for an improper purpose, the arbitrator may reallocate fees as permitted by the AAA rules.
17.6 30-day opt-out. You may opt out of this arbitration agreement by emailing hello@wyldgrow.com within thirty (30) days after you first create an account, stating your name, account email, and that you wish to opt out of arbitration. Opting out does not affect any other provision of these Terms.
17.7 Confidentiality. The arbitration, and any ruling or award, will be kept confidential except as needed to enforce it or as required by law.
17.8 Future changes. If we change this Section after you accept these Terms, you may reject the change by emailing hello@wyldgrow.com within thirty (30) days of the change, in which case you will arbitrate any dispute under the version of this Section you last accepted. Changes to this Section do not apply to any dispute about which you have already given us notice.
17.9 Governing law and venue. These Terms and any dispute are governed by the laws of the State of Delaware and applicable U.S. federal law, without regard to conflict-of-law rules, and the United Nations Convention on Contracts for the International Sale of Goods does not apply. Any claim that is not subject to arbitration must be brought exclusively in the state or federal courts located in Delaware, and you consent to their personal jurisdiction. Nothing in this Section deprives you of mandatory consumer protections under the law of your country of residence where those cannot be waived.
17.10 Time limit. To the extent permitted by law, any claim arising out of or relating to these Terms or the Services must be brought within one (1) year after it arises, or it is permanently barred.
17.11 EU, EEA, and UK consumers. If you are a consumer habitually resident in the European Union, European Economic Area, or United Kingdom: the arbitration agreement in Sections 17.2–17.8 does not apply to you unless you expressly agree to it after a dispute arises; you may bring proceedings in the courts of your country of residence; you benefit from the mandatory consumer-protection provisions of the law of that country; and you may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr (EU/EEA) or contact an approved alternative dispute resolution body (UK). Nothing in these Terms limits those rights.
18. Termination
18.1 By you. You may stop using the Services or delete your account at any time (Section 6.5). Termination does not entitle you to a refund except as stated in Section 7.9.
18.2 By us. We may suspend or terminate your account and access to the Services at any time, with or without notice, for any reason or no reason, including: breach of these Terms; false age, identity, location, or compliance information; our reasonable belief that you are under 18, under the applicable local cultivation age, or located where your cultivation is unlawful; sharing, distributing, or commercializing WYLD Grow Content, or attempting to circumvent technical protections; prohibited conduct; non-payment; a request by a platform provider or law enforcement; or conduct that we reasonably believe creates legal risk for us or harm to others. If we terminate for breach, you may not re-register.
18.3 Effect. On termination your license ends immediately, your access ceases, and we may delete your account and Your Content subject to our Privacy Policy and legal retention obligations. We are not liable to you for any termination.
18.4 Survival. Sections 2.4, 4, 5, 8.1–8.3, 8.7–8.10, 9.2–9.5, 10, 13.3, 14, 15, 16, 17, 18.3, 18.4, and 19 survive termination.
19. General Provisions
19.1 Changes to these Terms. We may update these Terms. We will post the updated version with a new "Last Updated" date, and for material changes we will give at least fourteen (14) days' notice by email or in-app notification before they take effect. Changes do not apply to disputes that arose before the change. Your continued use after the effective date is acceptance; if you do not agree, cancel your subscription and stop using the Services before that date.
19.2 Entire agreement. These Terms, the Privacy Policy, and any Supplemental Terms are the entire agreement between you and WYLD Grow regarding the Services and supersede all prior agreements on that subject.
19.3 Severability. If any provision is held invalid or unenforceable, it will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions remain in full force.
19.4 No waiver. Our failure to enforce any provision is not a waiver of it or of our right to enforce it later.
19.5 Assignment. You may not assign or transfer these Terms or your account without our prior written consent; any attempt to do so is void. We may assign these Terms without restriction, including to a successor or acquirer.
19.6 Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control, including natural disasters, network or hosting failures, cyberattacks, third-party service outages, labor disputes, or government action.
19.7 Injunctive relief. You agree that a breach of Sections 9.4, 10, or 11 would cause us irreparable harm for which money damages would be inadequate, and that we may seek injunctive or other equitable relief without posting a bond and in addition to any other remedy.
19.8 International use and data transfer. The Services are operated from the United States. If you use them from outside the U.S., you do so on your own initiative, are responsible for compliance with local law, and consent to the transfer and processing of your information in the United States as described in the Privacy Policy.
19.9 Interpretation. Headings are for convenience only. "Including" means "including without limitation." No relationship of agency, partnership, joint venture, or employment is created by these Terms.
